After verifying the non-correct use of public funds by the former mayor of Quintana (SP), Luiz Donizetti Martini, the local Federal Court ordered him to return to the public coffers R$ thousand and another R$ , a value which was no longer obtained with the application of the resource in the financial market, in updated values. Furthermore, according to the decision, the mayor ignored what was established in the agreement and, instead of a new minibus, ordered the acquisition of two kombi station wagons purchased for R$, each. The mayor, after incorporating the kombis into the municipality's assets, did not report the agreement to the MEC.
In his defense, Martini claimed there was no loss to the treasury and said that the acquisition of the vehicles was effective, without any change in the purpose of the agreement. For the judge, the act constituted administrative improbity, as it is different from mere irregularity, as it is correctable administratively due to the marked presence of dishonesty and bad faith.
